Judge lifts restraining order against Halle Berry but keeps visitation limits
A Los Angeles judge has dissolved a restraining order Olivier Martinez sought against his ex-wife Halle Berry, ABC News and the Los Angeles Times report. But Berry's time with their 13-year-old son stays limited for now. Lawyers on each side welcomed parts of the ruling.
A Los Angeles judge has dissolved a temporary restraining order against actor Halle Berry, ABC News and the Los Angeles Times report. Her ex-husband, Olivier Martinez, had obtained the order. Superior Court Judge Shelley Kaufman ruled on Thursday.
Martinez "did not sustain the applicable burden of proof" for his request for a protective order, the court document states, according to the Los Angeles Times. The judge had granted the temporary order earlier this month and barred overnight stays with Berry.
But Berry's visitation with their son, Maceo, stays limited to Mondays and Tuesdays and every other weekend, the outlets report. ABC News says the judge awarded Martinez primary physical custody until the pair return to court in November.
Berry and her son must attend 12 sessions of joint therapy over six months, the Los Angeles Times reports. A hearing to appoint the therapist is set for November.
Martinez had alleged that Berry physically attacked Maceo during a September incident. The boy was playing a virtual reality game at the time, ABC News reports. Berry said in a court filing that the two had been play-wrestling. Martinez had asked the judge for sole custody and an end to Berry's visits, the Los Angeles Times reports.
"We are extremely pleased that the Court has dissolved the TRO," Berry's lawyer, Marina Beck, said in a statement. Martinez's lawyer, Patrick Baghdaserians, called the outcome a "child-focused result" and said his client was "very happy." The couple divorced after two years of marriage and had agreed to share custody.
What we know: The judge dissolved the restraining order but kept Berry's limited visitation in place.
What we don't: What custody plan will follow the November court date.
Where outlets agree ABC News and the Los Angeles Times report the judge dissolved the restraining order and kept Berry's limited visitation.
Where they differ ABC News says the judge awarded Martinez primary physical custody, while the Los Angeles Times says earlier custody orders remain in force.
