A federal appeals court on Friday brought back a jury's finding that the NFL overcharged Sunday Ticket subscribers, The Hollywood Reporter and Reuters report. The court also ordered a new trial on how much the league owes, the outlets report.
The 9th Circuit Court of Appeals reversed a federal judge in California who had thrown out a $4.7 billion award after the 2024 trial, the outlets report. A jury's "verdict must stand unless it is clearly not supported by the evidence," the court wrote, The Hollywood Reporter reports.
The case claims the league and its 32 teams broke antitrust laws by making exclusive deals with TV partners to show out-of-market games, The Hollywood Reporter reports. Reuters reports the suit claims subscribers were overcharged for more than a decade.
The trial judge, Philip Gutierrez, had found that some expert testimony should have been kept out, The Hollywood Reporter reports. Much of that was from Daniel Rascher, who compared the NFL to college football. He said that without the league's deals, teams could sell their own game rights, as colleges do. The judge found that too speculative.
The three-judge panel disagreed. "Opinions are neither unfounded nor unreliable merely because they are impeachable," it wrote. "Such opinions are for the jury to weigh at trial." The panel said questions about how alike college and pro games are "are for the jury to decide," The Hollywood Reporter reports.
The case now goes back to the lower court, the outlets report. The panel said the $4.7 billion figure itself cannot stand, because the jury's finding on damages was not based on a proper look at the evidence, The Hollywood Reporter reports.
