Judge lets Halle Berry's son, 13, testify at restraining-order hearing
A judge in Los Angeles will let Halle Berry's son, Maceo, 13, testify in her legal fight with his father, Olivier Martinez. He may speak only about Martinez's request for a restraining order. Berry denies that she abused the boy, People and Complex reported.
A Los Angeles judge has ruled that Halle Berry's 13-year-old son, Maceo, may testify in the custody fight between Berry and his father, Olivier Martinez, People and Complex reported.
Judge Shelley Kaufman made the ruling at a hearing in Los Angeles Superior Court on Wednesday, Complex reported. Maceo will be allowed to testify at a hearing on Friday, but only about Martinez's request for a restraining order, both outlets reported. "The minor child shall not be coached," the judge said, according to Complex. TMZ first reported the ruling, People said.
Martinez, 60, is seeking a restraining order against Berry, 60, for himself and Maceo, People reported. On Oct. 1, he filed for sole custody, claiming that Berry "physically abused" Maceo in a Sept. 26 incident and alleging "other instances of abuse" in recent years. He was granted a temporary restraining order earlier this month, People reported.
"He should have the opportunity to have his voice heard regarding what he experienced that night," Martinez wrote in a declaration, People reported.
Berry objected to her son testifying, fearing that Martinez was coaching him on what to say, Complex reported. She asked the court not to put "substantial weight" on his testimony, People reported.
Berry has denied the accusation. "I have never physically, emotionally, or otherwise abused Maceo," she said in a declaration filed Oct. 5, according to People. "I am a victim of domestic violence, and I help victims of domestic violence."
Berry has said she and Maceo were roughhousing, not fighting, and she has completed a court-mandated parenting program, Complex reported. Her 18-year-old daughter, Nahla, submitted a sworn declaration defending her.
Representatives for Berry and Martinez did not immediately respond to People's request for comment.
What we know: Maceo can testify Friday, but only on the restraining-order request.
What we don't: What the judge will decide on the restraining order and custody.
