David Gonzalez III, a 32-year-old off-duty ICE officer from McAllen, Texas, pleaded not guilty Wednesday in Fresno County Superior Court, GV Wire and FOX26 reported.

He faces felony assault likely to cause great bodily injury, elder abuse, vandalism and battery after a fight on a Tower District lawn early Oct. 9. Prosecutors say he attacked a 72-year-old homeowner and the man's daughter after they found him sleeping on the lawn. The homeowner fired one round from a legally owned gun, striking him, and police took Gonzalez to a hospital, the district attorney's office said, according to GV Wire and FOX26. Prosecutors also say he threw the homeowner into a neighbor's parked car, and GV Wire reported the complaint puts the damage to that Hyundai at more than $400.

FOX26 said the court adjusted his bail to $37,000 from the $52,000 set when charges were filed Tuesday. Protective orders were served on the victims. His next hearing is Oct. 20. If convicted on all counts, Gonzalez faces up to four years and eight months in custody, prosecutors said, according to both outlets.

GV Wire, citing the Wednesday hearing before Judge Robert Mangano, said defense counsel Brian C. Andritch also contested how assault and elder-abuse counts were stacked, and that the judge set a stay-in-area condition with the bond. The Oct. 20 date is a preliminary hearing, though Andritch said a postponement is likely, GV Wire reported. Mangano did not allow media to photograph or film Gonzalez in court, the outlet said.

ICE has not said why Gonzalez was in Fresno. Homeland Security declined earlier comment, the Los Angeles Times reported when charges were announced.

What we know: Gonzalez pleaded not guilty; bail is $37,000; the next hearing is Oct. 20.
What we don't: Whether he remains hospitalized, and whether ICE will take any job action.
